Aircon Off Pty Ltd – Customer Warranty (“Warranty”). 1st July 2019

Aircon Off Pty Ltd ACN 155 713 527 (“Aircon Off”) provides the following Warranty for all Air Conditioning Control Equipment (“Goods”) purchased or subject to a rental arrangement in Australia which are intended for use in domestic residential (indoor) and commercial (indoor) installations. Commercial installations are all non-domestic residential installations including, but not limited to, offices, hotels, motels, short-term rental accommodation, factories, schools, hospitals, restaurants, staff and student accommodation and aged care facilities.

1. Warranty Statement

(a) If, during the warranty period set out in section 2 below (Warranty Period), the Goods have a material defect which arose in the course of manufacture or in circumstances where the Goods have developed an internal fault, then, subject to the below Warranty conditions, a customer may submit a Warranty claim to Aircon Off.

(b) Aircon Off will, at its cost, repair or replace the faulty goods if this is considered to be the most appropriate action. The customer must return the Good at their cost to Aircon Off premises within the specified timeframe and in accordance with the terms of this Warranty. Aircon Off will pay for return freight shipment costs of the replaced Goods back to the customer. Any replacement Goods will be covered for the remainder of the Warranty Period applicable.

(c) Any and all costs of repair or replacement outside the Warranty Period are the responsibility of the Customer.

(d) This Warranty is applicable only on Goods purchased and installed in Australia. For Goods shipped and installed outside Australia, please refer below for International Warranty terms.

(e) Our Goods come with guarantees that cannot be excluded under the Australian Consumer Law. The Customer is entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. The Customer is also entitled to have the Goods repaired or replaced if the Goods fail to be of acceptable quality and the failure does not amount to a major failure. The benefits under our Warranty are in addition to other rights and remedies under law in relation to these Goods.

(f) Domestic Customer 7 Day Refund Policy. We will provide a full refund for Goods which are returned to us undamaged, not tampered with and have not be used or installed. (The Smart Remote may be unpacked and then tried for compatibility but must be replaced in its packaging and returned in perfect condition to qualify for a refund). The customer must send the Goods back at their own cost ensuring the products arrive at our premises within 7 days of delivery to receive the refund. Our 7 day refund policy applies to online shop and direct retail sales only and does not apply to trade or commercial sales or purchases from 3rd parties. For trade and commercial sales, we will repair, replace or refund only within the terms of our Warranty.

2. Warranty Period:

Domestic and Commercial: Aircon Off air conditioning controllers AC-12, DC-12, AC-14. One Years Warranty from date of purchase for Goods purchased outright directly from Aircon Off on both Domestic/Residential and Commercial sales.  All other products including remote controllers and AC14 wireless accessories, One Year Warranty from date of purchase for Goods purchased outright directly from Aircon Off on both Domestic/Residential and Commercial sales.

Trade and Commercial with Finance or Rental Agreement: For Goods which are subject to a rental arrangement, the Warranty Period may, if required and at extra cost, be extended to match the term of the rental agreement.

The Aircon Off Warranty is subject to the following additional conditions for all customers:

(a) Proof of purchase (such as the invoice or evidence of a paid order confirmation) must be provided when making a claim under the Warranty. In the instance of mains powered unit, evidence must be provided to show that the product was installed by a licensed electrical contractor or fully qualified technician.

(b) All customers making a claim under the Warranty must comply with directions from Aircon Off staff in relation to troubleshooting any issue and facilitating the troubleshooting process prior to returning any Goods. The Goods must be returned to Aircon Off premises at the cost of the customer and must be received by Aircon Off. Aircon Off is not responsible for the cost of troubleshooting any fault, issue or setting, nor responsible for any costs associated with the removal, or re-installation of any item under any circumstances.

(c) If Aircon Off is unable to repair or replace the returned Goods, the customer will be provided with a replacement item or may be refunded the price of the Goods at the discretion of Aircon Off. Any refund will be for the full amount of the purchase price of the Goods excluding any associated cost of return of the Goods. The return of the Goods to Aircon Off is at the customer’s cost and any refund for these amounts is at the discretion of Aircon Off.

(d) Where Aircon Off requests a return of the Goods pursuant to this Warranty, it is the sole responsibility of the customer to ensure that the Goods reach Aircon Off Support Centre (or any other address provided by Aircon Off staff) in a safe and undamaged condition. The costs for removal and return of the Goods will be borne by the customer, however Aircon Off will deliver the replacement Goods to the customers address at Aircon Off’s own cost.

(e) 7 Day Refund Policy for Domestic sales only. We will provide a full refund for Goods which are returned to us undamaged, not tampered with and have not been used or installed. (The Smart Remote may be unpacked and then tried for compatibility, but must be replaced in its packaging and returned in perfect condition to qualify for a refund). The customer must send the Goods back at their own cost ensuring the products arrive at our premises within 7 days of delivery to receive the refund. Our 7 day refund policy applies to Domestic online shop and Domestic retail sales and does not apply to trade or commercial sales. For trade or commercial sales, we will repair, replace or refund only within the terms of our Warranty.

(f) Aircon Off Support Centre. Once the supply has been shipped from Aircon Off, the risk is transferred to the customer for any lost, damaged or stolen Goods while in transit. In such instance, the customer may claim against the relevant shipping company for such loss.

(g) Where a replacement of Goods is provided, the returned Goods become the property of Aircon Off. Replacement of the Goods under the Warranty does not extend or restart the Warranty Period unless the Goods are not fit for purpose or the reason for return is not permitted to be excluded under Australian law.

(h) Where Aircon Off has agreed to provide a replacement of the Goods, it is the sole responsibility of the customer to arrange and pay the cost of re-installation of any Goods. Aircon Off is not liable for the arrangement of any re-installation requirements and is not liable to pay for any costs associated with the original installation, subsequent removal or any re-installation of any goods at any time. (i) Aircon Off may seek reimbursement from the customer of any costs incurred where the Goods that have been returned to their premises are found to be in good working order.

(j)  Aircon Off reserves the right to use its reasonable discretion to determine whether any Goods are performing adequately in accordance with the Aircon Off Pty Ltd specifications, subject to applicable law. Variations in general performance which may be caused by various environmental or physical factors do not constitute a fault. 

(k)  This Warranty is non-transferrable to any third party. For the sake of clarity, this Warranty is personal to the original purchaser and cannot be transferred to a subsequent purchaser; and

Customer’s Responsibilities


Prior to calling for service assistance or warranty issues, please ensure you refer to your Operating Instruction Manual in particular any Troubleshooting advice. It is also recommended that you speak to your Installer before making a Warranty call.


a) Provide proof of purchase for any claim, maintenance, troubleshooting or other issues.
b) Operate and maintain the Goods in accordance with the Operating Instructions,

Warranty Exclusions

The Aircon Off Warranty shall not apply in respect of Goods:

(a) Where proof of purchase details (such as invoice or receipt) are not provided

(b) Where the Warranty Period has expired

(c) Where the Goods have not been installed, operated, maintained or used in accordance with the instructions or specifications provided with the Goods. In the instance of mains powered units, evidence must be provided to show that the product was installed by a licensed electrical contractor or fully qualified technician. A Certificate(s) of Compliance (or other approved similar certificate) must be obtained by the customer from the qualified installer and presented to the Aircon Off.

(d) Where repair work is performed on the relevant Goods by a person other than Aircon Off, its authorized service agents or any contractor who has not received authorization from Aircon Off prior to proceeding with the work

(e) Where harsh detergents, chemicals or abrasive cleaners are used on any surfaces of the Goods or if the Goods are damaged by abnormal use or cleaning

(f) Where the Goods are not installed in accordance with the relevant Australian Standards and Codes or as stated in the instructions provided with the Goods, or provided by email.

(g) Where the Goods have been tampered with by anyone other than an authorized technician.

(h) Where the Goods have suffered damage, corrosion, malfunction or failure resulting from alterations, accident, misuse, abuse, fire, heat, liquid, environmental factors, use of incorrect voltage, power surges and dips, thunderstorm activity, force majeure, voltage supply problems, insufficient ventilation, tampering by any persons, use of defective or incompatible accessories, exposure to abnormally corrosive conditions or entry by any insect, vermin or foreign object into the Goods or from use of any consumable (including batteries and cables) which may have corroded or caused any damage to the Goods

(i)   Where there is damage that arose during transportation, incorrect installation or while moving the Goods
(j)   Which suffer any failure, to the extent that the failure is not a failure of the Goods to perform in accordance with their specifications
(k)   That require replacement or repair of any consumables (including batteries and cables), or lost parts or accessories. For the sake of clarity, this Warranty only applies in respect of the actual Goods and not any accessory, cable, connector or consumable.
(l) That are outside the States and Territories of Australia. Aircon Off will, however, provide a replacement for faulty Goods sold directly by Aircon Off to customers that are outside of Australia subject to the International Limited Warranty below.
m) Where there is damage, problems or failure, perceived or real, resulting from improper operation and/or inadequate maintenance by the customer.
n) For use of the Goods in locations and situations outside of the recommended specifications.
o) For damage or problems or unsatisfactory performance resulting from operation in an environment where climatic comfort of humans is not the primary function of the equipment
p) In respect of any Goods which have been installed in a temporary structure or application including, but not limited to, a trailer, caravan or boat.
q) In respect of Goods which have been re-installed at a location other than the original installation site.
r) For installations where electrics/electronics may be subjected to moisture/chemicals (e.g. swimming pools or plant nurseries).
s) Where there has been any repair, which is needed as a result of an accident, misuse, abuse or negligence.
t) Where there is damage caused by leaking, damaged or exhausted batteries.
u) For any Good that is utilised in an environment (indoor & outdoor) outside its specified operating range or where environmental variations or factors may reduce performance.
w) In respect of fair wear and tear to the Goods.

Limitation of Liability

To the full extent permitted by law:

(a)   Aircon Off will not be liable for any direct, indirect or consequential loss or damage of any kind, including loss of revenue or profits, no matter howsoever occurring. This limitation of liability includes but is not limited to any third party loss or damage arising from the installation or use of the Goods as permitted by applicable law. This limitation includes but is not limited to any loss or damage suffered as a result of any installer or any installation issue or any lack of performance howsoever caused.

For the sake of clarity Aircon Off is not liable for any installation problems, issues or loss or damage which may be suffered as a result of any installer.

(b)  Aircon Off’s total and aggregate liability in respect of all claims under the Warranty shall not exceed the original purchase price of the Goods or, at Aircon Off’s option, replacement of the Goods or parts with similar Goods or parts.

(c)   Aircon Off excludes all other warranties, conditions, terms, representations and undertakings whether express or implied other than this Warranty; and

(d)  This Warranty is governed by and must be construed according to the laws of the State of Queensland, Australia and both the customer and Aircon Off agree to submit to the jurisdiction of the courts in that State.

International Limited Warranty

For customers outside of Australia that purchase Goods direct from Aircon Off, the above terms and conditions of Warranty may vary from this domestic expressly stated Warranty. Any shipment and/or freight, taxes, duties or customs charges will be borne by the customer.

Aircon Off will replace faulty Goods in its sole discretion.

To the fullest extent permitted by law in that country, Aircon Off excludes any liability for any direct, indirect or consequential loss or damage of any kind arising from the Goods or their use. These exclusions do not exclude Aircon Off’s liability in respect of any warranties implied by any relevant legislation in that country which cannot be legally contracted out of.
